Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and status as a newcomer motivated his push for 23XI Racing to “challenge” Nascar over perceived violations of antitrust rules.

Financial Stakes and a Will to Win

Jordan shared financial and corporate details of his 23XI team, revealing he invested $40 million of his own funds into the Nascar Cup series team co-founded with partner Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport required examination through a new lens.”

Central Issue: Franchise System and Contract Pressure

At issue is the end of a 2016 agreement where Nascar granted each team a franchise. This system mirrors other professional sports with separately owned franchises, such as the Charlotte Hornets or the NFL’s Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.

Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with fans and media clamoring for a glimpse or a photo of the sports legend.

Spearheading the Fight

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is unlawful to keep two hands on the wheel.

“Hamlin persuaded me adding a third car improved our chances to win,” he said, sharing that he bought a third charter late in 2024 for $28m despite the uncertainty. “So I dove in.”

Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She said the timing of the signature deadline didn’t sit well.

According to her, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, I have 30.”
